1. Introduction

These Terms of Service govern your access to and use of the Kin Strong website, platform and services. By accessing or using our services in any way, you confirm that you have read, understood and agreed to be bound by these terms. If you do not agree to these terms, please discontinue use of our services immediately. These terms form a legally binding agreement between you as the user and Kin Strong as the service provider.

2. Definitions

For the purposes of these Terms of Service the following definitions apply.

"Service" refers to the Kin Strong platform, website, AI driven systems, reputation management tools, automation workflows and any related features or offerings provided by Kin Strong.

"User" refers to any individual or organisation that accesses, registers for or uses the Service in any capacity.

"Platform" refers to the Kin Strong web based application and associated tools through which the Service is delivered.

"We," "Us" or "Kin Strong" refers to the company operating and providing the Service.

"Content" refers to any text, data, information, materials or other content submitted to or generated through the Platform.

3. Eligibility

To use our Service you must be at least 18 years of age or the legal age of majority in your jurisdiction. By using the Service you confirm that you meet this requirement and that you have the legal capacity to enter into a binding agreement. Our services are intended for business use and are not directed at individuals using the platform for personal, household or consumer purposes. Kin Strong reserves the right to refuse access to any user who does not meet these eligibility requirements or who is located in a jurisdiction where the Service is restricted or prohibited by law.

4. Account Registration

To access certain features of our Service you may be required to create an account. When registering you agree to provide accurate, current and complete information and to keep that information updated at all times. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately if you suspect any unauthorised access to or use of your account. Kin Strong is not liable for any loss or damage resulting from your failure to protect your account credentials.

5. Services Provided

Kin Strong provides AI driven systems for reputation management, workflow automation, client engagement and operational optimisation for professional service and trade businesses. The scope of services available to you will depend on the plan you have selected. Kin Strong reserves the right to modify, update, suspend or discontinue any aspect of the Service at any time with reasonable notice provided where possible. We are not liable for any disruption caused by changes or updates to the Service.

6. User Responsibilities

By using our Service you agree to use it only for lawful purposes and in accordance with these terms. You agree not to use the Service to engage in any activity that violates applicable laws or regulations, transmit spam, unsolicited communications or harmful content, attempt to gain unauthorised access to any part of the Platform or other systems, reverse engineer, copy, modify or distribute any part of the Service without our written consent, upload or share content that is defamatory, fraudulent, offensive or infringes on the rights of others and misrepresent your identity, affiliation or intentions when using the Service. Kin Strong reserves the right to suspend or terminate access for any user found to be in violation of these responsibilities.

7. Payment and Billing

Access to certain features of the Service requires payment. By selecting a paid plan you agree to pay the fees associated with that plan as outlined at the time of purchase. Subscriptions are billed on a recurring basis as specified during sign up and will automatically renew unless cancelled prior to the renewal date. You are responsible for ensuring your payment information is accurate and up to date. Cancellations must be made before the next billing cycle to avoid being charged for the following period. Refunds are assessed on a case by case basis and are not guaranteed except where required by applicable law. Kin Strong reserves the right to update pricing with reasonable advance notice to existing subscribers.

8. Intellectual Property

All content, software, systems, logos, trademarks and materials associated with Kin Strong and the Platform are the exclusive property of Kin Strong and are protected by applicable intellectual property laws. You are granted a limited, non exclusive, non transferable licence to access and use the Service for your internal business purposes only. You may not copy, reproduce, modify, distribute, sell or create derivative works from any part of the Service or its content without our express written consent. Any unauthorised use of our intellectual property may result in immediate termination of your access and legal action where appropriate.

9. Third Party Services

Our Platform may integrate with or contain links to third party services, tools or websites. These integrations are provided for your convenience and do not constitute an endorsement of those third parties. Kin Strong is not responsible for the availability, accuracy, content or practices of any third party service. Your use of third party integrations is subject to their own terms and conditions and privacy policies. We encourage you to review those terms before engaging with any third party service connected to our Platform.

10. Privacy and Data

Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy which is incorporated into these terms by reference. By using our Service you acknowledge and agree to the practices described in our Privacy Policy. We handle all personal information in accordance with applicable privacy laws and are committed to protecting your data at all times.

11. Termination

Kin Strong reserves the right to suspend or terminate your access to the Service at any time if you breach these terms, engage in prohibited activities or fail to make required payments. You may also terminate your account at any time by contacting us or following the cancellation process within your account settings. Upon termination you will lose access to the Platform and any data associated with your account may be deleted in accordance with our data retention policy. Provisions of these terms that by their nature should survive termination will continue to apply after termination.

12. Disclaimers and Limitation of Liability

The Service is provided on an as is and as available basis without warranties of any kind, either express or implied. Kin Strong does not guarantee that the Service will be uninterrupted, error free or free of harmful components. We do not guarantee specific results from the use of our systems or automation tools. To the fullest extent permitted by law, Kin Strong will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these terms or your use of the Service will not exceed the amount you paid to us in the three months preceding the claim.

13. Indemnification

You agree to indemnify, defend and hold harmless Kin Strong and its officers, directors, employees and agents from and against any claims, damages, losses, liabilities and expenses including legal fees arising out of or related to your use of the Service, your violation of these terms or your infringement of any third party rights. This obligation will survive the termination of your account and your use of the Service.

14. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms will be subject to the exclusive jurisdiction of the courts located in England and Wales. If you are accessing the Service from outside this jurisdiction you are responsible for compliance with local laws.

15. Changes to Terms

Kin Strong reserves the right to modify these Terms of Service at any time. When we make changes we will update the effective date at the top of this page and where changes are significant we will notify you via email or a prominent notice on our website. Your continued use of the Service following notification of updated terms constitutes your acceptance of those changes. We encourage you to review these terms periodically.

16. User Feedback and Content Submission

If you submit feedback, suggestions, ideas or other content to Kin Strong you grant us a non exclusive, royalty free, perpetual and irrevocable licence to use, reproduce, modify and incorporate that feedback into our Service without any obligation to compensate you. You retain ownership of any content you submit through the Platform, however by submitting it you grant Kin Strong the rights necessary to deliver the Service effectively.

17. Dispute Resolution

In the event of a dispute arising from these terms or your use of the Service, both parties agree to first attempt to resolve the matter through good faith negotiation. If a resolution cannot be reached within 30 days, the dispute will be referred to mediation or binding arbitration in accordance with the rules of London Court of International Arbitration (LCIA). Both parties agree that any dispute resolution process will be conducted on an individual basis and not as part of a class action.

18. Force Majeure

Kin Strong will not be held liable for any failure or delay in the performance of our obligations under these terms where such failure or delay results from circumstances beyond our reasonable control. This includes but is not limited to natural disasters, government actions, power outages, internet disruptions, cyberattacks, pandemics or any other event that could not reasonably have been anticipated or prevented. We will make reasonable efforts to resume normal service as quickly as possible following any such event.

19. SMS Terms and Mobile Messaging

By opting in to SMS communications from Kin Strong you agree to receive text messages related to our AI driven services, system updates, appointment reminders, service alerts and promotional offers.

Opt Out: You can cancel SMS messages from Kin Strong at any time by texting STOP to +1 760-660-5649. Once we receive your STOP message we will send a confirmation that you have been unsubscribed and no further SMS messages will be sent to you. To re subscribe simply opt in again as you did originally.

Carrier Limitations: Carriers are not liable for delayed or undelivered messages.
